The index certificates and the financial instruments products are not sold or promoted by those that prepare the price indexes; those that prepare such indexes make no explicit or tacit presentation or warranty to any owner of such products or to any person with regard to whether it is worthwhile to trade in such products.  The only connection between those who prepare the price indexes and Excellence and/or KSM is the licensing of certain trademarks and trade names of the index. Those that prepare the price index do not provide any warranty as to the accuracy and/or completeness of the index or to any figure presented therein, and they shall bear no liability for any errors, omissions, or interruptions related to such.  Those that prepare the indexes provide no explicit or tacit warranty whatsoever related to the results achieved by the licensee, the owners of the products, or any other person as a result of the use of the price index or figures presented therein, or to anything related to the negotiability or fitness of the index or related figures, for any specific use or purpose.   Without derogating from the above, those that prepare the price indexes shall bear no liability whatsoever, for any injury resulting from or related to the price index or the products, including, but not limited to, indirect, special, or consequential damages (including [without limitation] loss of profits),  regardless of whether they have been advised of the possibility of such damages.
20. The laws of Israel govern all use of this site and related activities, and the District Courts of Tel Aviv-Jaffa shall have exclusive jurisdiction and venue over all disputes related to this site.
21. The services presented on this site are not offered in jurisdictions in which the use of such is prohibited by applicable law.
